TERMS AND CONDITIONS OF SERVICE AGREEMENT

Effective Date(s): 2021 to Present

1. PARTIES AND NATURE OF AGREEMENT

This Agreement is made by and between Lake Area Transport Services LLC dba Ohio Party Bus (hereinafter “Ohio Party Bus”) and the Client. It is expressly understood and agreed that this document constitutes a contract for the carriage of persons over public roads and highways, in exchange for the payment of agreed charter fees. In consideration of such payment, the parties agree as follows:

2. SERVICES PROVIDED

Ohio Party Bus shall transport up to the number of passengers specified in the reservation and manifest as designated by the Client.

Charter service shall commence and terminate strictly according to the dates and times outlined in the reservation and manifest. No additional service, time, or transport shall be provided unless expressly requested and approved in writing or through documented communication during the service period.

3. DRIVER REQUIREMENTS

Ohio Party Bus shall ensure that all vehicles are operated only by a safe, careful, and qualified driver, at least 26 years of age, properly licensed, insured, and in full compliance with all applicable state and federal laws and regulations.

4. EQUIPMENT DAMAGE AND EXCESS CLEANING

The Client agrees to authorization of a damage security deposit hold as indicated in the booking reservation and further agrees to compensate Ohio Party Bus for any and all damages, excess cleaning, or biohazard cleanup resulting from the actions of passengers, guests, or invitees under this Agreement.

This includes, but is not limited to: spilled food or beverages, bodily fluids, smoking/vaping residue, or vandalism. Normal wear and tear associated with passenger transport is excluded.

5. CONTROL OF TRANSPORTATION

Ohio Party Bus retains full and exclusive control over all operational aspects of the transportation service, including but not limited to vehicle substitutions, routes, detours, rest stops, and seating arrangements.
The driver or company reserves the right to refuse unsafe requests or to discontinue service in the event of unruly, unsafe, or illegal behavior by passengers, without refund.

6. LIABILITY FOR INJURY OR PROPERTY LOSS

By executing this Agreement, the Client and all passengers acknowledge that they have also signed or agreed to a General Release of Liability Waiver, holding Ohio Party Bus harmless from any and all liability for personal injury, illness, or property loss resulting from voluntary or negligent acts by individual passengers.

This waiver does not release Ohio Party Bus from obligations covered under applicable commercial insurance policies or regulatory liability as required by law.

7. ITINERARY

The Client acknowledges that the charter itinerary provided with this Agreement is a binding component of this contract.
Any modifications to the itinerary are subject to approval and may result in additional charges.

8. AUTHORIZED REPRESENTATIVES

The Client authorizes any friend, family member, guest, event coordinator, or associate communicating with Ohio Party Bus staff or drivers regarding transportation details to act as the Client’s authorized representative.
Such individuals may make binding decisions, including extending service time, changing destinations, or approving additional stops or services.

9. AUTOMATIC CONTINUATION OF SERVICE

If transportation continues beyond the originally contracted time — whether by direct request, ongoing use, or direction of the Client’s guests or representatives — service shall automatically continue at the published hourly rate, rounded up to the next full hour.

Such continued use shall constitute the Client’s authorization for additional billing under these same terms and conditions.

10. PAYMENT TERMS AND AUTHORIZATION

The Client agrees to remit full and prompt payment for all contracted and additional services rendered.

If a valid payment method (credit/debit card, ACH, or stored authorization) is on file, the Client authorizes Ohio Party Bus to charge such method for any:

Remaining balances due,
Additional time or mileage,
Damages or cleaning fees, or
Other service-related charges documented via GPS tracking, driver logs, or communication records.

Further, unless disputed in writing within 24 hours of service completion, all charges shall be deemed accurate, valid, and authorized.

11. CANCELLATION POLICY

60 Days or More: Refund of all but 15% of the total charter fee.
30 Days or More: Refund of all but 25% of the total charter fee.
Less Than 30 Days Notice: No refunds for cancellations made within 30 days of the scheduled service date.
All damage security deposits or holds will be fully refunded or released, if applicable.

12. INDEMNIFICATION

The Client agrees to indemnify, defend, and hold harmless Ohio Party Bus, its owners, employees, affiliates, and agents from any claims, damages, or liabilities arising out of the actions, instructions, or behavior of the Client’s guests, representatives, or participants, including any directives given to the driver or staff during service.

13. FORCE MAJEURE

Ohio Party Bus shall not be held liable for delays, interruptions, or cancellations caused by events beyond its reasonable control, including but not limited to: severe weather, road closures, traffic accidents, mechanical failures, strikes, government orders, or acts of God. In such cases, reasonable efforts will be made to reschedule, provide substitutions, or provide partial refunds as applicable.

14. DISPUTE RESOLUTION

The Client agrees to first contact Ohio Party Bus directly to resolve any concerns before disputing any charges with their financial institution or payment provider.
Chargebacks or disputes on authorized transactions without prior communication may be considered breach of contract and subject to recovery and administrative fees.

15. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, with venue in Licking County, Ohio.

16. WAIVER ACKNOWLEDGMENT

Failure of any passenger to sign this waiver does not negate its enforceability.
By boarding, entering, or using any Ohio Party Bus vehicle or service, each passenger acknowledges and agrees to all terms and conditions contained herein, whether or not signed electronically.
